Abstract

The purpose of the paper is to substantiate Pashukanis’ critique of proletarian law. It is organised in two sections. It first expounds his account of legal form and the appearance of the individual as a subject of law, or legal personality. It then explores Marx’ argument about the connection between the sale and purchase of labour power in the ‘Eden of the innate rights of man’ and exploitation. The conclusion returns to his critique of proletarian law. Instead of the abstract equality before the law the classless society is founded on the equality of individual human needs.
