In Mexico lynchings represent a modern phenomena and any effort to view them as only traditional is problematic. The position that views customary law as a detonator of lynchings lacks forcefulness, and, in any case, would require further investigation. This essay proposes to respond to move the debate beyond the issue of what is and what is not legal by emphasizing a gray area between public lynchings and State executions.
